The O Way
Terms and Conditions
These are stipulations which apply to renting or owning land in The O Way. Remember, renting or purchasing land in O Way sims gives you protection from certain behaviors and non-zoned surroundings. But for it to work, this means you must abide by them as well. Most of what's listed here is about protecting the community and it's residents. Keep that in mind if you think any of them unfair or unreasonable.
BEHAVIOR - Naturally, any behavior that goes against the Second Life Terms of Service is not allowed. Below are some of the things NOT to do, especially to your neigbors:
- Stalking/Mapping/Following residents without invitation.
- Harassing residents. Any repeated behavior that is unwelcome. Definitions of this term at the discretion of Outy Banjo and management.
- Pointing/Firing/Swinging weapons at other residents. The use of weapons that have broad and far-reaching effects. "Nukes" and anything that has the potential to leave your land, or have effects outside of your land. Also, weapons that are detrimental to server performance.
- Using the Shout function excessively.
- Not complying with zoning rules for a particular sim. See Outy Banjo for the zoning rules of a sim. (Max build height, architecture style, etc)
- Using permanent sound devices that bleed into other areas. Use "Restrict spatialized sound to this parcel" in About Land, under Media to keep sounds from going beyond the property line.
PAYMENT - Regarding the funds for land you rent or own:
Note: All PayPal transactions are handled through the TUR Armory PayPal account(turarmory@theunruled.com). Sentry Real Estate, the TUR Armory, and theunruled.com are subsidiaries of Mark Shakocius(Outy Banjo).
- All money paid into rent machines, direct to Outy Banjo, or to the TUR Armory via PayPal are NON-REFUNDABLE unless it was a legitimate, typographical overpayment(Accidentally paying $500.00 instead of $50.00). This payment represents a contract of service. If you are planning on leaving the land prior to it's expiration, the land will still be yours until your paid service expires.
- In the event of early termination of your ownership or lease of the land based on violation of these Terms and Conditions, rent may or may not be refunded. The purchase price of the land may or may not be refunded. Violation of the Terms and Conditions forfeits your claim to any funds paid in.
Your trust with the management of your land and funds for the land is top priority. Early termination of your land ownership or lease will not be taken lightly. Every case will be reviewed carefully and thoroughly. This clause is typically only for the most extreme scenarios where a reasonable solution cannot be reached. This translates to, every case is different, and you likely won't be terminated on a whim for breaking a rule or two.
- When rental payment has expired, your land will then be considered free and will be cleared on the next land maintenance. The Rent Machine should inform you when your time left has reached 7 days, 3 days, and 24 hours. You can add more time to it by paying it at anytime. It is best to contact Outy Banjo or the sim's listed manager if there are special circumstances causing you not to meet this deadline.
- When a land fee payment in PayPal or other is missed, or has failed, there will be attempts to contact you. While no specific timelines are in place, if you cannot be reached, your land will at some point be considered abandoned and will be reclaimed with no refund of the purchase price. If you think there will be an interruption in your billing, contact Outy Banjo so that it can be discussed and possibly an extention can be granted. Ultimately, an inability to pay will result in reclamation of the land by Outy Banjo and forfeiture of the purchase price by the current owner.
Reclamation of the land will not occur without ginuine attempts to contact you. Circumstances can sometimes result in billing interruption. The best course of action is to contact Outy Banjo about it. No notification will leave no choice but to act on the non-payment.
SELLING YOUR LAND - You may sell your land you own to others. To do so, use the following steps:
- Work out the details of your transaction with your buyer. Price, etc.
- Notify Outy Banjo of the deal and have the buyer contact Outy Banjo to receive zoning information and terms and conditions, and to establish means of land fees billing.
- Once the new owner is cleared by Outy Banjo, you can go ahead with the transaction. Your subscription will then be cancelled. Remaining days in the billing cycle will not be pro-rated or refunded. It's best to complete this transaction prior to the next subscription billing date.
